Elon Musk’s brain-implant startup Neuralink may have misled regulators about Musk’s leadership role

Neuralink, the startup cofounded and run by Elon Musk that hopes to implant computer chips in people’s brains, may have misled federal securities regulators about the billionaire entrepreneur’s role at the company.

That’s according to government documents and Fortune interviews with securities lawyers and a half-dozen former employees of the company. The employees mostly spoke anonymously out of concern for violating nondisclosure agreements and possible retaliation from Musk.

The episode involves a 2018 letter in which an attorney representing Neuralink downplayed Musk’s leadership role at the company in a letter to the Securities and Exchange Commission. The attorney’s characterization contradicts former employees’ accounts, which depict Musk as very much in charge. Neuralink and the attorney involved in the filing did not respond to requests for comment. lawyer for Neuralink told the SEC that Musk had “no executive or management role” at the company. Former employees say that’s far from the truth.

Elon Musk has always said that Neuralink, the company he created in 2016 to build brain-computer interfaces, would do amazing things: Eventually, he says, it aims to allow humans to interact seamlessly with advanced artificial intelligence through thought alone. Along the way, it would help to cure people with spinal cord injuries and brain disorders ranging from Parkinson’s to schizophrenia.

Now the company is approaching a key test: a human clinical trial of its brain-computer interface (BCI). In December, Musk told a conference audience that “we hope to have this in our first humans” in 2022. In January, the company posted a job listing for a clinical trial director, an indication that it may be on track to meet Musk’s suggested timeline.

Musk has put the startup under unrelenting pressure to meet unrealistic timelines, these former employees say. “There was this top-down dissatisfaction with the pace of progress even though we were moving at unprecedented speeds,” says one former member of Neuralink’s technical staff, who worked at the company in 2019. “Still Elon was not satisfied.” Multiple staffers say company policy, dictated by Musk, forbade employees from faulting outside suppliers or vendors for a delay; the person who managed that relationship had to take responsibility for missed deadlines, even those outside their control.

Less than a year has passed since we saw Pager play Ping-Pong using Neuralink. The company’s owner, Elon Musk has now said that he is confident of testing the chip in humans next year.

Founded in July 2016, the company is busy building an implantable chip that will allow the human brain to interact with computers directly. The company made headlines when its experimental macaque played Ping-Pong telepathically, without the help of a joystick. The company seems to have made rapid progress in its technology since its founder is quite optimistic about human testing.
