But can we agree, at least for now, that having an AI determine your guilt or innocence in a court of law is a step too far?<\/p>\n<p>Worryingly, it seems <a href=\"https:\/\/www.wired.com\/2017\/04\/courts-using-ai-sentence-criminals-must-stop-now\/\">this may already be happening<\/a>. When American Chief Justice John Roberts recently <a href=\"https:\/\/www.youtube.com\/watch?v=TuZEKlRgDEg\">attended an event<\/a>, he was asked whether he could forsee a day \u201cwhen smart machines, driven with artificial intelligences, will assist with courtroom fact finding or, more controversially even, judicial decision making\u201d. He responded: \u201cIt\u2019s a day that\u2019s here and it\u2019s putting a significant strain on how the judiciary goes about doing things\u201d.<\/p>\n<p>Roberts might have been referring to the recent case of Eric Loomis, who was <a href=\"https:\/\/www.nytimes.com\/2017\/05\/01\/us\/politics\/sent-to-prison-by-a-software-programs-secret-algorithms.html?_r=0\">sentenced to six years in prison<\/a> at least in part by the recommendation of a private company\u2019s secret proprietary software. Loomis, who has a criminal history and was <a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docketfiles\/16-6387.htm\">sentenced for having fled the police in a stolen car<\/a>, now asserts that his right to due process was violated as neither he nor his representatives were able to scrutinise or challenge the algorithm behind the recommendation.<\/p>\n<p><!-- Link: <a href=\"https:\/\/www.weforum.org\/agenda\/2017\/05\/ai-sentencing-criminals-is-a-bad-idea-this-is-why\">https:\/\/www.weforum.org\/agenda\/2017\/05\/ai-sentencing-crimina...his-is-why<\/a> --><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Artificial intelligence is already helping determine your future \u2013 whether it\u2019s your Netflix viewing preferences, your suitability for a mortgage or your compatibility with a prospective employer.
