Senate Bill 205, passed in 2024, is one of the nation\u2019s first attempts to regulate \u2018high-risk\u2019 AI systems and protect consumers from \u2018algorithmic discrimination\u2019 \u2014 or disparate treatment or impacts on protected classes under Colorado law.<\/p>\n

In the complaint, which was filed in federal court in Denver, Musk\u2019s lawyers contend that the law is \u2018unconstitutionally vague\u2019 and \u2018invites arbitrary enforcement\u2019 because it fails to define some key terms. They also contend that Colorado\u2019s law would cause Musk\u2019s AI chatbot, Grok, to \u2018abandon its disinterested pursuit of truth and instead promote the State\u2019s ideological views on various matters, racial justice in particular,\u2019 which they say violates the First Amendment.<\/p>\n

\u2018Unless the implementation and enforcement of SB24-205 is enjoined, it will violate xAI\u2019s constitutional rights and cause irreparable constitutional harm, impose enormous burdens on xAI and the AI industry, and substitute Colorado\u2019s political preferences for the national economic and security imperative of American AI dominance,\u2019 the complaint reads in part\u2026<\/p>\n

\u2026State Rep. Briana Titone, D-Arvada, one of Senate Bill 205\u2019s lead sponsors, told The Sun that Musk\u2019s lawsuit seems like a \u2018fishing expedition\u2019 that misinterprets the core of the law.<\/p>\n

\u2018This is where the disconnect is. SB 205 is about consequential decisions, not about freedom of speech,\u2019 Titone said. \u2018It\u2019s completely detached from it. And they\u2019re trying to use this argument for a law that has nothing to do with what he\u2019s saying. We\u2019re not restricting speech. Our bill does not say that Grok still can\u2019t be a dick.\u2019<\/p>\n

The lawsuit was filed at a time when the Trump administration looks to preempt state regulation of AI models through executive fiat.<\/p>\n
