As far as we know, this is the first case of its kind as the DOJ looks to establish a judicial precedent that exploitative materials are still illegal even when no children were used to create them. \u201cPut simply, CSAM generated by AI is still CSAM,\u201d Deputy Attorney General Lisa Monaco <a data-i13n=\"elm: context_link;elmt: doNotAffiliate;cpos:1;pos:1\" class=\"\" href=\"https:\/\/www.justice.gov\/opa\/pr\/man-arrested-producing-distributing-and-possessing-ai-generated-images-minors-engaged\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk: wrote;elm: context_link;elmt:doNotAffiliate;cpos:1;pos:1;itc:0;sec:content-canvas\" data-rapid_p=\"13\" data-v9y=\"1\">wrote<\/a> in a press release.<\/p>\n<p>The DOJ says 42-year-old software engineer Steven Anderegg of Holmen, WI, used a fork of the open-source AI image generator <a data-i13n=\"cpos:2;pos:1\" href=\"https:\/\/www.engadget.com\/stable-diffusion-3-is-a-new-ai-image-generator-that-wont-mess-up-text-in-pictures-its-makers-claim-233751335.html\" data-ylk=\"slk: Stable Diffusion;cpos:2;pos:1;elm: context_link;itc:0;sec: content-canvas\" class=\"\" data-rapid_p=\"14\" data-v9y=\"1\">Stable Diffusion<\/a> to make the images, which he then used to try to lure an underage boy into sexual situations. The latter will likely play a central role in the eventual trial for the four counts of \u201cproducing, distributing, and possessing obscene visual depictions of minors engaged in sexually explicit conduct and transferring obscene material to a minor under the age of 16.\u201d<\/p>\n<p>The government says Anderegg\u2019s images showed \u201cnude or partially clothed minors lasciviously displaying or touching their genitals or engaging in sexual intercourse with men.\u201d The DOJ claims he used specific prompts, including negative prompts (extra guidance for the AI model, telling it what <em>not<\/em> to produce) to spur the generator into making the CSAM.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The US Department of Justice arrested a Wisconsin man last week for generating and distributing AI-generated child sexual abuse material (CSAM).
